Welcome to Fizzy Lifting, operated by Pontoon Brewing Company, LLC (“Company,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of www.drinkfizzylifting.com (the “Site”), including any purchases of our hemp-derived THC beverages and related products (collectively, the “Services”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site or purchase our products.

1. AGE REQUIREMENT

You must be 21 years of age or older to access the Site and to purchase or consume our hemp-derived THC products. By using the Site, you affirm and certify that you meet this age requirement.

We reserve the right to verify your age and cancel any order if age verification cannot be completed.

2. COMPLIANCE WITH FEDERAL & STATE LAWS

Our products are hemp-derived and contain no more than 0.3% Delta-9 THC by dry weight, as permitted under the 2018 Farm Bill.

However, THC laws vary by state and are subject to frequent change. You are solely responsible for understanding and complying with your local and state regulations, including age requirements, possession limits, and legality of hemp-derived THC beverages.

We reserve the right to cancel orders that cannot legally be shipped to your location.

3. SHIPPING POLICY

We currently ship to the following U.S. states:
AK, AR, AZ, DC, DE, FL, GA, HI, IA, IL, IN, KS, KY, LA, MA, ME, MI, MN, MO, MS, NC, ND, NE, NH, NJ, NM, NV, OH, OK, PA, SC, SD, TN, TX, UT, VT, WA, WI, WV, & WY.

Order Processing & Fulfillment

• Orders ship from our Georgia fulfillment center.
• Processing time: 1–2 business days, Monday–Friday.
• Orders placed before 2pm EST generally ship the same day.
• Orders placed after 2pm EST on Fridays ship the following Monday.
• High-volume periods (sales events, product drops, holidays) may cause delays.

You will receive an email confirmation when your order is placed and another when your order ships, including tracking information.

Shipping Costs

• Flat rate: $9.99 for orders up to $100.
• Free shipping on orders over $100.
• Orders typically ship via USPS, though FedEx or UPS may be used depending on speed or reliability.

4. RETURNS, REFUNDS & EXCHANGES

We accept returns within 30 days of delivery if the item is unused, unopened, and in original condition. Refunds will include the full order amount minus return shipping costs.

If your order arrives damaged, please email ali@pontoonbrewing.com with:

• Your order number
• Photos of the damaged product and packaging

We handle these cases individually and will work with you toward a satisfactory resolution.

5. PRODUCT USE & SAFETY DISCLAIMER

By purchasing or consuming Fizzy Lifting products, you acknowledge the following:

• Our products contain hemp-derived cannabinoids, including THC.
• Effects may vary and may include intoxication or impairment.
• Do not operate a vehicle or heavy machinery after consuming our products.
• THC products may result in a positive drug test.
• Consult a physician before use if you are pregnant, nursing, have a medical condition, or take medications.
• Keep products out of reach of children and pets.

6. FDA DISCLOSURE

The statements on this Site and on our product packaging have not been evaluated by the Food and Drug Administration (FDA).
